An appellate court in NY ruled Thursday that a lawsuit by a former "Apprentice" contestant who accused President Trump of unwanted kisses and groping can proceed - shutting down claims by his lawyers that Trump is immune from defamation lawsuits while in office and raising the specter that he will have to sit for sworn questioning. Daniels, whose given name is Stephanie Clifford, had argued that Trump defamed her when he suggested that she had lied about being threatened to keep quiet about their alleged past relationship.

She came forward in October 2016, the month before Trump was elected, after an "Access Hollywood" recording showed Trump speaking in vulgar terms about women.

The president's lawyers then appealed.

Kasowitz said in a statement on Thursday that the team "respectfully" disagrees with the majority decision in New York's Appellate Division and expects to prevail upon appeal in a higher court.

Zervos sued in 2017, saying Mr. Trump had hurt her reputation, harmed her business and caused threats to be made against her. Several other women have also accused Trump of improper sexual conduct.

The judges cited the U.S. Supreme Court's ruling in Clinton v. Jones, which ruled that presidents can still be sued while in office for unofficial acts. But in their ruling on Thursday, the court said that finding the president in contempt would be a "hypothetical scenario that is highly unlikely to occur in the context of this lawsuit".

Two of the five justices on the panel, Peter Tom and Angela M. Mazzarelli, said in a dissent, written by Mazzarelli, that subjecting the president to a state trial court's jurisdiction "interferes with his ability to carry out his constitutional duty of executing the laws of the United States".

Zervos appeared on "The Apprentice" in 2006, when Trump was the reality show's host.

A lawyer for the Trump Organization did not immediately respond to a request for comment.
