Supreme Court Won't Review Decision That OK'd Obama-Era Net Neutrality Rules

In court papers, Solicitor General Noel Francisco asked the justices to take up the case this term and argued that district judges who had issued opinions against the administration were "wrong" to do so.

"The administration's repeated and unjustified efforts to subject Dreamers to deportation are nothing but cruel, and there is no justification for circumventing appellate court review", Tom Jawetz, vice president of immigration policy at the Center for America Progress Action Fund, said in a statement following the filing.

The Supreme Court said Monday that it will not hear a closely watched case over the future of the internet - rejecting a petition by telecom industry groups to consider net neutrality, or the principle that internet providers should treat all online content equally. That suit, which is also pending before the D.C. Circuit, is quickly becoming the center of the legal battle over net neutrality now, with the Supreme Court deciding not to hear its net neutrality case.

The new rules, which gave internet service providers greater power to regulate the content that customers access, are now the subject of a separate legal fight after being challenged by numerous groups that backed net neutrality.

The legality of the separate DACA program for undocumented immigrant youths had never been tested in court (although an expansion of that program fell with the court rulings against the program for undocumented parents).

The lower court rulings left the 700,000 protected but prevented any more from registering for the program. Those are the orders that the Administration has now asked the Justices to overturn.

Although the Supreme Court rarely grants requests to bypass the appeals court stage, the DACA case involves unusual circumstances.

"Absent prompt intervention from this court, there is little chance the court would resolve this dispute for at least another year", Francisco wrote in a letter to the Supreme Court.
