Two Republican women could sink Trump's US Supreme Court pick

Dershowitz Kavanaugh should read Constitution Hero or villain? Trump's court pick is in for a fight

It's too soon to know what kind of fight President Donald Trump has on his hands in nominating federal judge Brett Kavanaugh to the Supreme Court.

Sen. Chuck Schumer of NY, the Democratic leader, said in an interview Wednesday that Kavanaugh's belief in broad presidential authority was "just off the deep end". He said it's different with mid-term elections. Rather than just playing it safe with a broad swath of voters anxious about access to health care and abortion, Democrats now see an opportunity to excite their base by fanning fears that the highest court in the land could turn into a bulwark to protect the man appointing its members. Orrin Hatch, R-Utah, on Capitol Hill, July 11, 2018.

The opposite is true of Republican Sen.

The second set will target the three Democrats who voted for Gorsuch - Heidi Heitkamp, of North Dakota, Joe Donnelly of IN, and Joe Manchin of West Virginia.

Collins has backed all three conservative justices nominated by Republican presidents while she has been in office. "I expect his confirmation to go well". They view the uphill battle against Kavanaugh as similar to their successful fight last summer to preserve the health care law from a Republican repeal effort. Both explore issues that are deeply relevant to Trump and the ongoing investigation into Russia's interference in the 2016 election.

That could have been a nod to Senate Judiciary Democrats who said Tuesday that they want to review every piece of paper related to Kavanaugh's public service, including his work in the George W. Bush administration. But their lines of attack have expanded.

"If the American people come to believe this court would overturn women's reproductive freedom and the ACA, we would get a majority of votes", he added.

Kavanaugh said he has worked as a school tutor for struggling kids. Trump could run into the same problem if Democrats re-take control of the Senate in November. "He clearly is qualified for the job", Collins said.

"I really consider Kavanaugh a friend of all the bill of rights provisions, I've studied other opinions of his, so yes, he would be a friend of the Second Amendment", said Stephen Halbrook, a lawyer and Senior Fellow at the Independent Institute. And in this case, the muddled messaging threatens to dampen a new surge of voter enthusiasm just a few months before midterm elections. "Yet the current Senate majority seems determined to weaken the Senate's role and leave the president's appointment power essentially unchecked", the newspaper said.

One key swing vote, Sen. Susan Collins of ME and Lisa Murkowski of Alaska. "But nevertheless it's an issue that I certainly will raise with him".

Democrats plan to paint the Supreme Court appointee as a threat to abortion rights. Murkowski said last week that the 1973 Supreme Court ruling legalizing abortion will be a "significant factor" in her decision on how to vote. With Sen. John McCain, R-Ariz., receiving cancer treatment in his home state, Republicans need all 50 Republicans, plus Pence as a tiebreaker, to confirm Kavanaugh, assuming no Democrats join them. "A judge must interpret statutes as written, and a judge must interpret the Constitution as written, informed by history and tradition and precedent".

The report took a more liberal approach to the definition of obstruction of justice, but after seeing the toll that investigations can take on presidents, Kavanaugh rescinded his approach and now argues that presidents should be exempt from criminal prosecutions and civil suits. The President's job is hard enough as is.

Sasse says the strong politicization of Supreme Court nominees deeply concerns him.
