Design Patent Battle Revives Between Samsung and Apple
17 May, 2018, 01:04
In opening arguments for a damages phase of the patent suit - Samsung already has been found to infringe - Apple attorney argued that three design patents, while covering merely cosmetic aspects of iPhones, are in fact key to making the phones look good and work well.
Apple and Samsung are confronting each other in a California court for a third trial including a similar arrangement of five patents.
The trial is the latest in a long and ongoing dispute which Samsung estimates is worth around $28 million.
Lee showed the jury a series of Samsung phones released before, shortly after and years after the iPhone's debut in 2007.
The three design patents in this case relate to the iPhone's distinctive design features - including the phone's black rectangular face, the stainless-steel rim that surrounds the face (called a bezel) and the graphical user interface that appears on the screen when the phone is turned on. "Samsung might want to say just because you have a design doesn't mean you own the world".
Retrial judge Lucy Koh who also sat in the first case has said she intends to apply a “Groundhog Day” rule
Apple then took the smartphone market by storm due to how it packaged technology, rather than developing the technology itself. The jury ruled that the infringement was willful, and said that Samsung must payApple $1.05 billion. "To make something exactly like the iPhone". In that capacity, it stated, the sum ought to have been restricted to the estimation of the culpable parts and not the entire gadgets. The case was decided in Apple's favor in 2012 and it was awarded $1.05 billion in damages.
After a round of appeals, Koh lopped $405 million off the jury's original damages award, ordering Samsung to pay up to the tune of $548 million. Apple originally sought $2.75 billion in damages.
Apple's lawyer Bill Lee has said that Samsung made a profit of around $1 billion by violating the company's design patents which Samsung is of the view that it should only be made to pay the amount it made by violating the specific patents and not the entire profits of the devices through which these patents were infringed.
According to the BBC, retrial judge Lucy Koh has said she intends to apply a "Groundhog Day" rule, whereby through referencing the 1993 movie, she will restrict the two companies to only presenting new evidence rather than regurgitating previous evidence.
