Facebook's facial recognition tool faces class action suit over mishandling biometric data

US District Judge James Donato ruled in a San Francisco federal court on Monday that a class-action lawsuit was the most efficient way to resolve the dispute.

Facebook can probably recognize that its users' faces are angry. In a statement, Facebook said the case "has no merit and will defend ourselves vigorously". However, the lawsuit is based on the earlier collection of user data.

A California judge has ruled that a class-action lawsuit against Facebook's use of facial-recognition technology can go ahead - signaling further legal woes for the social network. This argument hinges on an IL law called the Biometric Information Privacy Act (BIPA), which states a private entity can't store an individual's biometric information without written consent, nor profit from the data.

The facial recognition tool, launched in 2010, suggests names for people it identifies in photos uploaded by users - a function which the plaintiffs claim runs afoul of IL state law on protecting biometric privacy. Per Facebook's request, the case has been moved from IL to California. "If a face signature falls within the boundary describes by a user's face template, Facebook suggests tagging the user", it said.

The European Union's digital chief is also slated to meet with the embattled CEO amid increasing criticisms from activists in Europe that the company is engaging in manipulative and deceitful conduct in order to impose facial surveillance on European users.

In the worst data leak in company history, Facebook initially reported that 50 million of its users' private information was used without consent by United Kingdom -based Cambridge Analytica for critical political voting in that country and the U.S.

A Facebook spokesperson told CNN the company is reviewing the ruling.

As the scandal unfolded, the Electronic Privacy Information Center said it would challenge Facebook's use of facial recognition with the Federal Trade Commission.

"It really puts Facebook's business model into question, and people might feel differently about what they put online if they feel manipulated by the platform", said Jennifer Krueckeberg, lead researcher at privacy advocacy group Big Brother Watch.
