U.S. District Judge Nicholas Garaufis in NY ruled Tuesday that Attorney General Jeff Sessions had "erred in concluding that DACA is unconstitutional" and granted a preliminary injunction sought by state attorneys general and immigrants who had sued the administration.

But on January 9, US District Judge William Alsup in San Francisco ordered the administration to partially revive the program and resume accepting renewal applications, finding that the challengers who sued over the rescission were likely to succeed in arguing that it was "arbitrary and capricious".

The Trump budget predicted a savings of $210 million per year from that elimination - but this new GOP immigration plan would increase spending on the SCAAP program to $950 million - seemingly a $3.5 billion increase over a five year period.

Meanwhile, efforts in Congress by DACA supporters to rescue the program continue, with debate starting this week in the Senate on proposals in favor of protecting the "Dreamers".

"Although the Government generally has a substantial interest in the speedy deportation of removable aliens ... the court finds that the Government's interest in ending the DACA problem is not so compelling", Garaufis wrote in his ruling.

President Donald Trump in September rescinded the Obama-era scheme, which protects some 800,000 people and provides temporary permits for work and study.

President Donald Trump's administration didn't offer "legally adequate reasons" for ending a program that spared many young immigrants from deportation if they were brought to the United States as children, Garaufis ruled Tuesday as he ordered the program to continue. But the consolidated NY lawsuit ― which combines a case originally filed on behalf of DACA recipient Martín Jonathan Batalla Vidal with a suit filed by attorneys general from 15 Democratic-led states and the District of Columbia ― argues that the administration violated DACA recipients' due process rights and the terms of the Administrative Procedure Act when changing the policy.

"The Trump administration should be able to alter the policies and priorities set by its predecessor", Garaufis said. The program was first introduced by former President Barack Obama in 2012. The third is U.S. Citizenship and Immigration Services.

The plaintiffs had argued that the administration violated federal law by cutting off a program that hundreds of people relied on with little explanation.

The administration will not have to accept new applications for the programme, but will have to continue accepting renewals.

Trump was referring to a deadline he announced previous year to end a program protecting young immigrants from deportation.
