Bermuda repeals same-sex marriage legislation in world first

Bermudan Governor John Rankin approved the repeal Wednesday night, outlawing same sex-marriage for the island, a British territory that is self-governing.

In December, the majority of Bermudan legislators voted in favor of the bill, which effectively swaps same-sex marriage for domestic partnership.

Minister of Home Affairs Walton Brown said the change was made in an effort to maintain protection for same-sex couples while easing opposition against same-sex marriage.

Same-sex couples previously married under Bermuda law will continue to be recognized as being married and overseas same-sex marriages taking place before and during the transitional period will be recognized as marriages in Bermuda, Rankin said.

LGBT rights groups said domestic partnerships amounted to a second-class status and it was unprecedented for a jurisdiction to take away the legal right to marriage after it had been granted.

Yesterday, the British Overseas Territory in the North Atlantic became the first place in the world to repeal a judgment allowing same-sex marriage.

As reported by local news outlet Bernews, Rankin stated that same-sex couples have the same rights as heterosexual couples under the new law, which include the right to make medical decisions for one's partner.

The British territory, which only legalised gay marriage in May 2017 thanks to a Supreme Court ruling, has seen six same-sex weddings in the eight months leading to now. He continued, "This decision strips loving same-sex couples of the right to marry and jeopardizes Bermuda's global reputation and economy".

The move ended weeks of speculation over whether Britain would allow the legislation, and dashed the hopes of activists in Bermuda and overseas who had asked Mr Rankin to reject the new law.

The conservative-minded British island territory in the Sargasso Sea rolled back a relatively recent move to condone same-sex marriage, opting instead to recognize domestic partnerships, to the chagrin of its small homosexual community.

He added the partnerships will give same-sex couples rights “equivalent to those enjoyed by heterosexual married couples — rights that were not guaranteed before the passage of this Act”.

Labor MP Chris Bryant labelled the bill a "deeply unpleasant and very cynical piece of legislation".

In the United Kingdom, opposition politician Chris Bryant said that British foreign secretary Boris Johnson had not opted to intervene in the Bermudian legislation being passed, something that he said "totally undermines" British efforts to advance LGBT rights. However, he would need to seek consent from Boris Johnson, the UK's Foreign Secretary.

"I feel enormously disappointed", 64-year-old married gay Bermudian Joe Gibbons told The Telegraph. "While the UK Government is disappointed with the implications of this bill, this is a matter for the Bermuda government acting within the terms of the Bermuda constitution and in accordance with worldwide law".
