As Salvadorans Lose US Protections, Will Some Seek Asylum in Quebec?

Under the Trump administration the Department of Homeland Security has announced the end of TPS for immigrants from El Salvador Haiti Sudan and Nicaragua but extended it for immigrants from South Sudan. And this year the agency will decide whether Anti-immigration fever strikes again

During a bipartisan meeting on immigration Thursday, President Donald Trump criticized protections the U.S. gives to immigrants from various underdeveloped countries, including Haiti, El Salvador, and African countries. In addition to being part and parcel of its war on immigrants (particularly low-income ones), it is a denial of US responsibility for much of what drives Salvadorans to flee their homeland and makes life there unviable.

Those in support of ending El Salvador's TPS status argue that the initial event that qualified them for the status is long since over. The law "prohibits judicial review of any determination with respect to the designation, termination, or extension of TPS" and "prohibits the Senate from considering legislation that would adjust the status of TPS aliens to that of a lawful temporary or permanent resident" once the status is removed, according to former House Judiciary Committee immigration counsel Nolan Rappaport. His children are US citizens and his wife is a permanent resident. Moreover, there's nothing to stop the administration, if it wished, from designating these national groups for TPS anew based on current conditions in their countries.

History matters here. Civil war wracked El Salvador from 1980 to 1992 (the U.S. backed the government in its bloody suppression of a leftist insurgency), which sparked an exodus of Salvadorans to the U.S. In Los Angeles, that led to the creation of the notorious Salvadoran gangs, such as MS-13, whose leaders and members eventually were deported back to El Salvador, planting the seeds for the rise there of the powerful street and drug gangs that have made contemporary El Salvador numbingly violent.

Congress and President Donald Trump are working to extend the popular immigration program, so he may be able to stay, even if his parents can't.

As Temporary Protected Status (TPS) ends for about 200,000 Salvadorans living in the USA, some may venture to Quebec, following other groups who have also lost protections under the Trump administration. That's the likely impact of phasing out the Temporary Protected Status, a 20-year program aimed to help people come here from countries suffering from natural disasters and armed conflicts.

In the same way, the assistant of the Minister of Immigration, Hursh Jaswal, assured that immigrants who need protection would be allowed to stay, while the others will be "removed" from the country.

The majority of Central America's TPS recipients are parents of children born in the United States, with many supporting children still living in their homeland.
