Consumer users will continue to see ads displayed on their Gmail accounts.

US District Judge Lucy Koh ruled in March that the settlement was hard to understand and "does not clearly disclose the fact that Google intercepts, scans and analyses the contents of emails sent by non-Gmail users to Gmail users for the purposes of creating user profiles of the Gmail users to create targeted advertising".

According to Diane Greene, senior vice president at Google Cloud, the decision reflects the company's desire to bring its consumer product more in line with its enterprise service, which she said had more than doubled in use in the past year.

Gmail scanned only the emails of private users, business accounts being exempted. Google's practice of scanning emails for user data is also the subject of a federal lawsuit.
