Samuel DuBose Shooting Trial Results in Second Hung Jury

A mistrial was declared Friday in the murder retrial of a white University of Cincinnati police officer after the jury said it was hopelessly deadlocked on charges in the fatal traffic stop shooting of an unarmed black motorist.

But prosecutors said DuBose's vehicle didn't start moving until after he was shot and that Tensing had a choice to let DuBose drive away rather than shoot him. And all six Baltimore officers charged in the 2015 killing of Freddie Gray, who succumbed to spinal cord injuries suffered in the back of a police van, eventually walked; officers arrested the victim after they considered his eye contact suspicious. The first round also ended in a mistrial past year with a jury unable to come to a unanimous verdict after deliberating for more than 20 hours.

DuBose's family members released a statement after a mistrial was declared, commending prosecutors for their "strong presentation in this case", but adding that they were "outraged that a second jury has now failed to convict Ray Tensing for the murder of our beloved Sam DuBose".

"Ray Tensing had a choice to make that evening", Hamilton County Assistant Prosecutor Seth Tieger said, according to CNN.

Tensing said he thought about the fatal encounter "every moment for the last two years" during last week's appearance on the stand.

Instead, they sent her another note some three hours later saying: "We are nearly evenly split regarding our votes".

She called on the Cincinnati community to join them in "peaceful protest" of what she called an "unjust result".

On Friday, a grand jury in OR declined to indict a police officer who killed a 24-year-old man, who was allegedly armed with a knife.

There was no agreement among the experts, for example, about whether DuBose pinned Tensing's arm against the steering wheel.

Mr Tensing was sacked past year by the University of Cincinnati, which announced an overhaul of its policing department. The university police fired him after he was charged. The university reached a $5.3 million settlement with DuBose's family, including free undergraduate tuition for DuBose's 13 children.
