The 2015 Playmate of the year quickly became the target of online venom for the so-called body shaming incident.

It appears former Playboy model Dani Mathers is headed to trial over the infamous photo she shared on social media that mocked a nude 70-year-old woman in a gym locker room. She posted the image along with a selfie of her feigning a look of horror and the caption "If I can't unsee this then you can't either". According to New York Daily News, this line of argument rejected outright: "The court finds the statute is constitutional and not void for vagueness", Judge Gustavo Sztraicher ruled. Mathers' lawyer Dana Cole argued that the elderly woman in Mathers' photo was not identifiable and that it took the police hours to figure out who she was.

Mathers' attorney stated that she plans to testify. Mathers subsequently deleted her social media accounts and was reportedly banned from the LA Fitness location where she took the picture.

Now, Mathers' last-minute attempt to avoid trial has failed and she will finally be facing the legal consequences of her actions.
